January 2018 I filed a complaint with the Maryland Attorney General office of Consumer protection regarding Indian Acres. Property owners in the community had requested and been denied access to the annual budget for the operating expenses.

Indian Acres then attorney, James Dellmyer who is the current States Attorney for Cecil County Maryland filed a response denying we are an HOA. But the attorney general felt we had a reasonable right to transparency.

Seems Indian Acres and the States Attorney wants the state of Maryland and the judges of Cecil County to overlook the fact they have perpetually filed a 1120-H US Income Tax Return for Homeowners Associations since inception. However they refuse to abide by the Maryland HOA rules and feel they don’t have to.

After digging through countless records at the county building I came across information that has been buried and forgotten. Records and letters from the developer WSC and the county commissioners verifying we are an HOA. However, Judge Emory Plitt disregarded this information in open court. Laughing at it.

Now Cecil County Attorney Jason Allison sends a letter to a property owner stating we are in fact an HOA, when its convenient to the county and they don’t want any involvement.
