January 2018 I filed a complaint with the Maryland Attorney General office of Consumer protection regarding Indian Acres. Property owners in the community had requested and been denied access to the annual budget for the operating expenses.
Indian Acres then attorney, James Dellmyer who is the current States Attorney for Cecil County Maryland filed a response denying we are an HOA. But the attorney general felt we had a reasonable right to transparency.
Seems Indian Acres and the States Attorney wants the state of Maryland and the judges of Cecil County to overlook the fact they have perpetually filed a 1120-H US Income Tax Return for Homeowners Associations since inception. However they refuse to abide by the Maryland HOA rules and feel they don’t have to.
After digging through countless records at the county building I came across information that has been buried and forgotten. Records and letters from the developer WSC and the county commissioners verifying we are an HOA. However, Judge Emory Plitt disregarded this information in open court. Laughing at it.
Now Cecil County Attorney Jason Allison sends a letter to a property owner stating we are in fact an HOA, when its convenient to the county and they don’t want any involvement.
As this shows it uncovers a illegal subdivision. Owned and operated by unsavory individuals and made up companies by those same people.
I purchased almost 20 years ago and was lied to by Bob Minnisal PERIOD! He told me I would own my own land and as long as I cleared it with him I most likely be able to do it.
Then he went on and told me I would be able to retire there. Not that it was in my plans but it was doable according to him!
Hell I will quote him telling me after he did the settlement in his office, ” Jim, I have between 200 to 300 retired folks living here now.”
Now he even told me “that the board needs to get it self together that he was looking towards us taking the reins soon.” Then he would say “its gonna be rough taking it over if we didn’t have 80% of the lots”.
We find out that we’ve had over 80% since 1998!!!!! He knew it then and he knew it on Thanksgiving eve 2016 when he sold it. I’ve seen poof of that also!
We will win our Acres back soon…….we have been doing our own research. They will be packing soon. Just count how they have been increasing our dues. They don’t spend it on improvements for us. They are for them. They complain about no money? They both are spending dues money as a cash cow for them, PERIOD.
They won’t answer questions from any of us. Their employees have changed and become defensive. They have no set rules to follow. They have been making changes to our declarations and by-laws. We don’t know what they all are! Seriously we don’t.
They have a board that pretty much underhanded I might say that.

We all need to join together. If you are afraid of RETALIATION like many are helping us behind the scenes will be fine. Just tell us what you can. We need old original papers showing your,original purchase and anything you can share. We are so-so close to watching them tucking their tails while sprinting away!
The taxes, dues they will have to pay now will make Indian Acres a splendid affordable place, for real!
Like they promised at the county meeting everyone went to and Joe liked talking to reporter and told her that All he wants to do is clean it up. It will stay affordable! HaHa!
